Terms and conditions
1. General provisions
1.1. These Terms and Conditions (further – TC) is a legal obligatory document which determines rights and responsibilities of Buyer and Seller (UAB Noras group, company code 301846337, V. Grybo g. 17-129, LT-10318 Vilnius, trade brand – Beatričės Gėlių Namai) conditions of purchase and payment of products and service (further – products), procedure of delivery and return of the Products, responsibility of the parties and other provisions concerning buying-selling of the products at the online shop beatricesgeles.lt.
1.2. Seller reserves the right to change, correct or supplement the TC regarding requirements determined by legislation. Buyer is informed at the website of the online shop. TC applicable to the Buyer when he/she is purchasing at the online shop are valid at the time of order submission.
1.3. The right to shop at our online shop have natural persons with legal capacity; underage people from 14 to 18 years with the permission of parents or custodians, except the cases when they manage their own income; legal entities.
1.4. By confirming the TC the Seller guarantees that the Buyer has the right to shop at the online shop based on 1.3. paragraph of the provisions.
1.5. The agreement between the Buyer and the Seller is valid from the moment when the Buyer clicks “Place Order” button hen he/she has already formed the products cart, written the shipping address, chosen the way of payment and read the TC of the Seller at the online shop.
1.6. Every agreement between the Seller and the Buyer is saved in the online shop.
1.7. Products displayed at the online shop by the Seller – flowers, bouquets, flower arrangements other products with flowers (further – flower arrangements) are the example of the product made from various flowers (cut flowers, preserved flowers, dried flowers, artificial flowers), plants, decoration and packing material. Every flower arrangement made by the Seller is unique and may differ by color, form, content, material and other qualities.
2. Security of personal data.
2.1. The Buyer can order products at the online shop:
2.1.1. by signing up at the online shop and submitting the data required for sign-up.
2.1.2. without sign-up.
2.2. When Buyer is purchasing products by the ways provided in the paragraph 2.1. of the TC, he/she must indicate personal data of the Buyer and the receiver which is necessary for the proper realization of the delivery in the information fields: name, surname, address of the delivery, telephone number and e-mail address.
2.3. By confirming these TC the Buyer agrees that personal data submitted in the paragraph 2.2. would be processed in the online shop for the purposes of Seller’s activity analysis and direct marketing. We guarantee not to reveal your personal information to third parties. This obligation is not valid in the cases provided in the legislation of the Republic of Lithuania.
2.4. By agreeing that Buyer’s personal data would be processed in the online shop for the Seller’s purpose, Buyer also agrees to receive information necessary for the order to indicated e-mail and telephone number.
2.5. By registering and ordering at the online shop Buyer guarantees to save and not to reveal the sign in data.
3. Rights and obligations of the Buyer.
3.1. Buyer has the right to purchase at the online shop in the accordance with the procedure of these TC and other information of this online shop.
3.2. Buyer has the right to withdraw the buying-selling agreement from the online shop by informing the Seller about it in writing (by e-mail, indicating the number of the order) not later than three workdays before the day of product’s delivery or dispatch.
3.3. In the case of Buyer’s withdrawal in the accordance with the procedure of paragraph 3.2. money for the purchase will be returned to the payer within 20 workdays withholding the taxes for remittances.
3.4. The Buyer undertakes to pay the cost of the products.
3.5. If Buyer’s data indicated in the registration form changes the Buyer must immediately update it.
3.6. The Buyer undertakes not to give his/her sign in data to third parties. If the Buyer loses sign in data, he/she must immediately inform the Seller by the communication means indicated in the “Contact us” section.
3.7. By using the online shop the Buyer agrees with theses TC and guarantees to obey them and not to break the legislation of the Republic of Lithuania.
4. Rights and obligations of the Seller.
4.1. The Seller guarantees to create the necessary conditions for the Buyer to use the service of the online shop. In the relevant circumstances the Seller has the right to withdraw the activity of the shop temporarily or permanently without informing the Buyer in advance.
4.2. The Seller has the right to limit or suspend Buyer’s ability to use the online shop immediately and without warning or in exceptional cases cancel Buyer’s registration.
4.3. The Seller undertakes to respect Buyer’s privacy right to Buyer’s personal data indicated in the registration form in the online shop.
4.4. The Seller commits:
4.4.1. to deliver the products purchased by the Buyer to the indicated address when the Buyer purchased the delivery.
4.4.2. to give the products to the Buyer at V. Grybo street, 17, Vilnius, at the day indicated by the Buyer.
4.4.3. in all cases products are given to the Buyer or the person indicated by the Buyer only when the agreed price of the products is paid.
4.4. The Seller has the right to withdraw the buying-selling agreement if there are not enough proper resources for the products indicated in the agreement, also if the agreement was concluded by a person who in accordance with these TC did not have the right to conclude the agreement.
5. Order and making of the products, prices, procedure of payment, terms.
5.1. At the online shop the Buyer can purchase products all day, 7 days per week.
5.2. The agreement becomes valid from the moment, when the Buyer clicks “Place Order”. When the order is received, the Seller confirms it by sending a confirming e-mail to the mail address indicated by the Buyer.
5.3. The prices in the online shop and in the formed order are given in euros including VAT (value-added tax).
5.4. The Buyer pays for the products by one of the following ways:
5.4.1. money transfer. By choosing this way the Buyer transfers money to the Seller’s bank account in the way which is most convenient to the Buyer: by connecting to his/her Internet bank account and making the transfer, by the account provided by the Seller or going to a chosen bank branch and making the transfer according to the Seller’s account. In this case the bank is responsible for the money’s safety because all cash transactions runs through electronic banking system.
5.4.2. by using Paysera.lt (Mokėjimai.lt) – banks, payment cards Visa, MasterCard, Maestro, also Maxima cashiers, RKiosk and others. By choosing this way of payment the Buyer will be directed to the Paysera.lt (Mokėjimai.lt) payment system. In this case „Paysera LT“, UAB, Mėnulio street. 7, LT-04326 Vilnius, Lithuania is responsible for the safety of the data.
5.4.3. by using credit card via PayPal or PayPal Braintree payment system. In this case PayPal (Europe) S.à r.l. et Cie, S.C.A., Société en Commandite par Actions Registered Office: 22-24 Boulevard Royal L-2449, Luxembourg RCS Luxembourg B 118 349 is responsible for the safety of the data.
5.4.4. by coming to the Seller at V. Grybo street, 17, Vilnius and paying by cash or via payment card.
5.5. The Buyer must pay for the products immediately if he/she orders the products including delivery. The Seller has the right to cancel the order without informing the Buyer in advance if the Buyer does not pay for the products in 1 workday when having chosen the payment way written in the TC (except for paying by cash or payment card at V. Grybo street, 17, Vilnius).
6. The delivery of the products.
6.1. If the Buyer chooses to include the delivery when ordering the products, then he/she must indicate the exact place of the delivery, name, surname and telephone number of the receiver. The Seller may ask for additional information which can be necessary for the delivery – number of the hotel room, hospital ward, office or other.
6.2. The products are delivered only in Vilnius city and in the suburbs of Vilnius (max 5 kilometers from Vilnius) on workdays from 9:00 to 20:00 and on Saturdays from 10:00 to 20:00, also on these celebrations – Valentine’s day, 8th March, Mother’s Day. The earliest day of the delivery is the day after confirming and paying for the order. The parties may agree on making the delivery the same day, on Sundays, rest-days or other celebrations.
6.3. The delivery time indicated by the Buyer (for example, 18:00-20:00) is indicative and can differ from the actual time, in any case the Seller will try to deliver the products at the indicated time of the day.
6.4. The delivery is considered completed when the product is given to the receiver or his/her relatives, neighbors, colleagues, office workers, hotel reception, the staff of medical institution in the case of the receiver’s absence or if the Seller cannot reach him/her.
6.5. The products are delivered by the Seller or a representative authorized by the Seller (a courier).
6.6. The Buyer agrees that the delivery can be late due to unforeseen circumstances which do not depend on the Seller. In this case, the Seller must immediately inform the Buyer and agree on delivery conditions.
6.7. When accepting the shipment, with the participation of the courier, the recipient shall examine the parcels of the shipment. Should any damage to the packaging of the parcels be noted, the recipient must note this in the proof of parcel delivery. Seller shall not assume any liability for damage to the shipment or any part thereof, if at the time of delivering it to the recipient this had not been noted in the scanner or the act of parcel damages (inspection) had not been drawn up with the participation of the courier who delivered the shipment.
6.8. If the seller cannot deliver the product due to unforeseen circumstances which do not depend on the Seller or if the receiver refuses to receive the product, it will be stored at V. Grybo street. 17, Vilnius. The term of flower and flower arrangement storage is 1 day, in other cases – 7 days. During this term, the Buyer can take back the products in the premises of the Seller. After this term, the money for the product is not returned and the claims are not considered.
7. Product quality assurance.
7.1. We provide 12-hour quality guarantee for flowers and flower arrangements after the delivery if their housing conditions meet the following requirements – the cut flowers are immersed in water; the temperature of the environment is 5 to 25 degrees Celsius; there is no direct sunlight or draft. Warranty terms determined by the manufacturer are applied for other products.
7.2. The Seller cannot guarantee that purchased flowers or flower arrangements will be identical to those which are shown in the photograph. Every flower arrangement made by the Seller is unique and may differ in coloring, form, content, material and other features. The Seller attempts that a flower arrangement would match the shown example to the maximum and has the right to change the bouquet’s or arrangement’s content by maintaining its monetary value, coloring and forms.
7.3. The Seller is not responsible if the products shown in the online shop by their coloring, forms and other features do not match the real size, form or color of the products due to the monitor properties used by the Buyer.
8. Withdrawal from the Contract. Exchange and return of goods.
8.1. Plants, flowers, flower arrangements may be returned to the Seller at his premises V. Grybo str. 17, Vilnius, within 12 hours of delivery if the Buyer has a claim for quality. The buyer bears the cost of returning the goods.
8.2. The Buyer shall have the right to withdraw from the this contract by notifying the Seller in writing form no later than 14 (fourteen) days from the date of delivery of the goods. 8.3. The Buyer must return the goods to the Seller UAB NORAS GROUP, V. Grybo g. 17-129, LT-10318 Vilnius, immediately or in any case no later than fourteen days from the date on which the Buyer informed Seller of the revocation (withdraw) of this contract. Buyer bear the direct costs of returning the goods.
8.4. A Buyer is any natural person who concludes the contract for a purpose which can not be attributed predominantly to either his commercial or independent occupation
8.5. Plants, flowers and food of appropriate quality shall not be replaced or returned.
8.6. In accordance with the provisions of the Civil Code of the Republic of Lithuania and the Retail Trade Rules of the Republic of Lithuania, the following quality goods shall not be replaced or returned:
8.6.1. goods which are not prefabricated and whose manufacture is subject to an individual selection or destination by the consumer or which are clearly tailored to the personal needs of the consumer;
8.6.2. plants, flowers and other perishable goods or goods with a short shelf life;
8.6.3. sealed goods which are not suitable for return on grounds of health or hygiene if their seal has been removed after delivery;
8.6.4. perfumery and cosmetic goods;
8.6.5. photographic and cinematographic goods;
8.6.6. printed books, reproductions and other products of the printing industry;
8.6.7. men’s, boys ‘, women’s or girls’ underwear;
8.6.8. baby clothes;
8.6.9. bedding goods;
8.8.10 toys, games;
8.6.11. works of art.
8.7. The quality goods returned must be intact, unadulterated in appearance, consumable and must not be used. The item must be returned in its original packaging, with the same set as received by the Buyer, with the necessary proof of purchase, warranty card (if issued), instructions for use and other accessories of the item. The Buyer shall be liable for any loss in value of the goods if this loss in value is attributable to a handling which is not necessary for the purpose of checking the quality, characteristics and functioning of the goods. If the item is incomplete, damaged, disordered or not properly packaged, the Seller has the right not to accept the item, to replace it or to refund the money paid by the Buyer for the item.
8.8. Not later than within 14 (fourteen) calendar days from the date when the Buyer submits the completed withdrawal form and returns the goods to the Seller, the Seller shall refund the money paid to the Buyer for the goods. If only a part of the purchased goods is returned, shipping costs are non-refundable.
8.9. The Seller shall execute the refund using the same payment method as the Buyer used for the initial payment transaction, unless the Buyer has explicitly agreed to another payment method.
8.10. The Seller has the right not to refund for the goods:
8.10.1. until the Buyer returns the goods to the Seller;
8.10.2. if the goods do not comply with the requirements in contract section 8.6.
8.10.3. if the goods are not in the package in which they were delivered or the packaging is damaged, disordered or otherwise damaged;
8.10.4. if the item was used.
8.11. The buyer who wishes to complain about a poor quality product (except plants, flowers, flower arrangements) can do so by e-mail info@beatricesgeles.lt or at UAB NORAS GROUP, V. Grybo g. 17-129, LT-10318 Vilnius. When making a complaint, the Buyer must provide the following information:
8.11.1. order number;
8.11.2. a picture of the defective product, clearly showing the defect;
8.11.3. picture of product packaging;
8.11.1. poor quality description.
8.12. The Seller undertakes to investigate the claim and respond within 14 (fourteen) calendar days.
9. The responsibilities of the Buyer and the Seller.
9.1. The Buyer takes full responsibility for the rightness of the personal data indicated by the Buyer. If the Buyer does not indicate accurate personal data in the registration form, the Seller is not responsible for the consequences and has the right to ask for compensation for incurred direct damages.
9.2. The Buyer is responsible for the actions performed in this online shop.
9.3. A registered Buyer is responsible for revealing his/her sign in data to third parties. If a third party uses services of the online shop by using the data of the Buyer, the Seller regards it as a Buyer.
9.4. The Seller is exempted from any responsibility in the cases when damages occur if the Buyer did not consider the recommendations of the Seller and obligations of the Buyer by not reading the TC when this opportunity was given to him/her.
9.5. If there are links to websites of other companies, organizations or people in the Seller’s online shop, the Seller is not responsible for the information or the activities carried out in these websites. The Seller does not supervise or control the websites nor does the Seller represent the companies or people.
9.6. The Seller is not responsible for the content of the message in the postcard sent with the flowers and flower arrangements by the Buyer.
9.7. In the case of occurred damage, the guilty Party refunds expenses to the other Party.
10. Marketing and information.
10.1. The Seller in its discretion can initiate various sales in the online shop.
10.2. The Seller has the right to unilaterally without warning change the conditions of the sales or remove them. Any change or removal of the sales is valid from the moment it is carried out.
10.3. The Seller sends all messages by the means of communication indicated by the Buyer in the registration form.
10.4. The Buyer sends all messages and questions to the phone numbers and e-mails indicated in the “Contacts” section of the Seller’s online shop.
10.5. The Seller is not responsible if the Buyer does not receive information or confirmation messages due to troubleshooting of Internet connection or service providers of e-mail webs.
11. Dispute Resolution and EGS Platform
11.1. The Buyer, in order to submit a complaint, must contact the UAB Noras Group directly, by sending an email to info@beatricesgeles.lt.
11.2. If the Buyer is not satisfied with the final response of UAB Noras group, due to the out-of-court settlement of consumer disputes, he can apply to the State Consumer Rights Protection Authority of the Republic of Lithuania, address Vilniaus g. 25, LT-01402 Vilnius, Lithuania, e-mail tarnyba@vvtat.lt, phone +370 5 262 6751, website www.vvtat.lt or fill out an application form on the EGS platform: https://ec.europa.eu/consumers/ odr /.
11.3. In implementing the European Parliament and Council Directive no. 2013/11 / EU on Alternative Dispute Resolution for Consumer Disputes and European Parliament and Council Regulation No 524/2013 on electronic consumer disputes The European Commission has set up an Electronic Consumer Dispute Resolution Platform: https://ec.europa.eu/consumers/odr/. It is an electronic tool by which consumers can claim a seller when goods or services are purchased online.
12. Final provisions.
12.1. TC are formed in accordance with laws and legislation of the Republic of Lithuania.
12.2. All disagreements which come from the implementation of these TC are solved by the means of negotiation. In the case of agreement failure, disputes are solved in accordance with legislation of the Republic of Lithuania.
12.3. These TC are available in various different languages. In case of conflict between the Lithuanian version of the Terms and Conditions and any of its official translations, the Lithuanian version takes precedence.
